Court Dismisses Injunction Against ECG Privatisation

THE Commercial Court in Accra presided over by Justice Jerome Nkrumah has dismissed an interlocutory injunction seeking to stop the Millennium Development Authority (MiDA), the body spearheading the exercise, from going ahead with the concession process.
The injunction was filed by the BXC Company Limited, one of the companies that lost the bid to manage the ECG under the concession arrangement.
BXC argued that it was unlawfully disqualified from the bidding process by MiDA, describing the disqualification as “arbitrary and without basis.’’
But, the respondent said the applicant has no right to make such comment saying losses that would be incurred would be adequately compensated.
Justice Nkrumah in his ruling said, the concession process has a timeline and in the event that the court grants the application, the state and ECG will suffer damages in which the applicant cannot compensate them.
Daily Heritage’s Court Correspondent Muntalla Inusah who was in court reports that the court denied the application to prevent loss of funds to the state.
